Many people assume that the right to remain silent without judgment is automatically applied. While it is true that once you’ve been arrested for a crime you have the right to remain silent without it being used against you, the issue is not so simple for those who are under investigation, though not under arrest. 

To invoke your right to remain silent during a criminal investigation, you must actually say the words, “I plead the 5th.”
